The appellant, David Dwayne Carpenter, was convicted of theft of property in the first degree, a violation of § 13A-8-3, Code of Alabama 1975. He was sentenced to life in prison pursuant to the Habitual Felony Offender Act.
The state's evidence tended to show that on the evening of July 3, or in the early morning of July 4, 1988, Bennie Scott's automobile, a 1976 Chevrolet Camaro, was stolen from his mother's driveway in Russellville, Alabama.
