The defendant, Harry Hollenberg, was arrested on October 2, 1941 charged with violating an ordinance of the City of Scranton, approved December 30, 1940, entitled, “An ordinance for promoting the public health, safety, comfort and welfare throughout the City of Scranton by regulating the sale, re-sale, exchanging or disposing in any manner of any used or second-hand plumbing fixtures and providing a penalty for violation thereof.” The complaint was sworn to by the plumbing inspector of the city.
