MEMORANDUM OPINION
MARVIN ISGUR, Bankruptcy Judge.
On October 31, 2003, Diego and Sylvia Mugica 1 filed a complaint in the District Court of Hidalgo County, Texas, against multiple defendants, both diverse and non-diverse, asserting claims of negligence, trespass, nuisance and nuisance per se, gross negligence and malice, intentional infliction of emotional distress and strict liability.
