Defendant, Lee Anderson Cody, who was also known by the nickname “Tooky,” was convicted by a jury of the crime of assault with intent to do great bodily harm without malice upon one Erline Reed. It having been alleged in the indictment and stipulated by the parties that defendant had a previous felony conviction, the court assessed his punishment at four years in the Missouri State Penitentiary under the Habitual Criminal Act, Section 556.280 RSMo 1959, V.A.
