In an action to recover damages for defamation, the defendant Robert Cooper, appeals from an order of the Supreme Court, Suffolk County (Seidell, J.), dated August 5, 1994, which denied his motion pursuant to CPLR 3211 (a) (7) to dismiss the complaint for failure to state a cause of action, or, in the alternative, pursuant to CPLR 3211 (c) for summary judgment dismissing the complaint.
Ordered that the order is affirmed, with costs.
