This was an action brought by the plaintiff against the defendant, as an attorney at law, to recover a sum of money alleged to have been collected by him, and which he refused to pay to the plaintiff when demanded. The defendant pleaded thal the plaintiff ought not to maintain his action against him because the whole matter had been settled and determined by a judgment of the superior court of Sumter county upon a rule nisi embracing the same subject matter.
