This action is brought pursuant to the provisions of article 5 of title 1 of chapter 14 of the Code of Civil Procedure, to compel the determination of a claim to real property.

The complaint alleges ownership in fee and possession by the plaintiff of a certain village lot in the village of Saranac Lake, and alleges that the defendant, a municipal corporation, unjustly claims title to or an easement in a strip' of about eleven feet wide across the southerly side and the westerly end thereof as a public highway.
