This action was commenced by the plaintiff in error in the distrito court of Doniphan county, on the 9th day of February, 1886. It is an action in ejectment to recover the possession of eighty acres of land, and to *425recover rents and profits. The plaintiff below and plaintiff' in error is a grandson of one Michael Bunting, who by will devised his estate, real and personal, to his wife during her lifetime, and then to descend to his legal heirs.
