MEMORANDUM ORDER AND OPINION

PALLMEYER, District Judge.

Plaintiff, Wlodzimierz Kwiatkowski (“Kwiatkowski”), filed a three-count complaint against Defendant, Volvo Trucks North America (“Volvo”), alleging breach of a written warranty (Count I), and breach of the implied warranty of merchantability (Count II) and seeking to revoke his purchase of a 2007 Volvo semi-tractor trailer from a dealer in Ohio (Count III). Each claim is based on the Magnuson-Moss Warranty Act (“the Act”), 15 U.S.C. § 2301 et. seq., which governs warranties on consumer products. Defendant Volvo has filed a motion to…
