BACKGROUND
Plaintiff, Nabisco Brands, Inc. (“Nabisco”) commenced this action against defendants Arnold Kaye and Arnie’s Deli, Ltd. (collectively “Kaye”) claiming that defendants’ use of the mark “A.2.” constitutes trademark infringement in violation of 15 U.S.C. § 1114.
