The appellant was the plaintiff, and the appellees were the defendants. The facts alleged in the complaint arc as follows: On the 27th of February, 1861, Morris, one of the defendants, recovered a judgment in the Marion Common Pleas Court, against Kirland, for $10,727 and costs. An execution was issued on this judgment, and directed to the sheriff of Marion County. There were payments endorsed on the execution to the aggregate amount of $4,900, and a payment of all costs, except $14.
