The question at issue in this case is whether what is said to be a road adjacent to the defendant's property and leading from a gravelled road in the Plaisance area of St. Landry Parish to the plaintiff's property in the rear is a public road or whethit is part of the defendant's property and as such private property. The defendant acquired his property from Adolph Guillory on August 1, 1944, and as he claims that the strip in controversy is part of his property and therefore subject to his private ownership and control, he placed three gates across it thus obstructing its use to the public.…
