Defendant appeals from a judgment of the Franklin County Court of Common Pleas imposing a sentence of one to five years, following his plea of no contest to one of the indictments charging him with breaking; and entering — a violation of R. C. 2911.13. In support of his appeal, defendant raises a single assignment of error, as follows:

“The Common Pleas Court erred in not discharging the defendant, upon his motion, pursuant to Ohio Rev. Code,. Sec. 2945.73, and denied him his rights, as guaranteed by the Ohio and United States Constitutions, to a speedy trial.”
