The jury found him guilty without capital punishment. His appeal is based on errors alleged to have been committed on the trial and in the proceedings had in the court below, which are embodied in five bills of exception.

Three of these bills, 1, 3, and 4, are co-related, involving the same subject-matter, and will be considered together.
