SUTTON, Justice.

This cause is here for review on writ of error from the District Court of Live Oak County. The suit was brought and tried on the third amended original petition of James M. Davenport and George Davenport, individually and as executors and sole devisees of W. L. Davenport, to recover on certain vendor’s lien notes against D. W. Snyder, and to foreclose the vendor’s lien on certain lands described in their petition, situated in Live Oak County, against D. W. Snyder, A. J. Felton, the Great Southern Life Insurance Company, W.
