In an action to recover damages for breach of a lease, the defendant appeals from an order of the Supreme Court, Kings County (Held, J.), dated April 4, 1989, which denied his motion for summary judgment dismissing the complaint and for summary judgment as to liability in his favor on his counterclaims.
Ordered that the order is reversed, on the law, with costs, the defendant’s motion is granted to the extent that the complaint is dismissed and plaintiff is adjudged to be in breach of a lease dated November 6, 1986, and the matter is remitted to the Supreme Court, Kings County, for trial on…
