Wells, J. :

The appellant, George York, was com victed in the district court of Osborne county of keep*292ing and maintaining a common nuisance in the city of Downs, under the provisions of section 39 of chapter 101 of the General Statutes of 1897, and judgment was rendered accordingly. From this judgment he appeals to this court', and specifies eleven alleged errors as reasons why said judgment should be vacated and set aside. These we will consider in their order, so far as it seems necessary to do.
