— Order, Supreme Court, New York County (Harold Baer, Jr., J.), entered on or about September 30, 1991, which, upon renewal, denied the plaintiffs motion to dismiss the defendant’s defenses and granted the defendant’s cross motion for summary judgment dismissing the complaint, unanimously modified, on the law, to deny the defendant’s cross motion for summary judgment, the complaint is reinstated, and otherwise affirmed, without costs.
