The defendant in error filed her petition in the district court of Fremont County, in the matter of the estate of Julius A. Schuelke, deceased, under the provisions of Section 4835, Revised Statutes 1899, to determine the heirship to the deceased, she claiming to be his widow and sole heir, and as such entitled to the residue of his estate upon'final settlement.
