Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered September 21, 2012, convicting defendant upon his plea of guilty of the crime of criminal possession of marihuana in the second degree.
Defendant waived indictment and entered a guilty plea to criminal possession of marihuana in the second degree in exchange for a sentencing promise, as an admitted second felony offender, of 2½ years in prison with two years of postrelease supervision (hereinafter PRS).
