BER CURIAM.

This is an appeal from a judgment of the district court of Carter county in an action wherein the plaintiffs in error were plaintiffs and the defendants in error were defendants.

The cause was submitted to the court on December 20,-1928, on an agreed statement of ■ facts, - covering, all the facts submitted, filed in the cause on October 20, 1928. The cause was taken under advisement until February 15, 1929, at which timé judgment was rendered for the defendants,' to which the plaintiffs excepted.
