This is a criminal complaint which charges the defendant with being a lewd, wanton and lascivious person in violation of G. L. 1956, §11-45-1, as amended. The defendant was found guilty in the fourth district court and was sentenced to serve 18 months at the adult correctional institutions. He took an appeal to the superior court where he filed a plea in abatement to the charge. The question raised by the defendant’s plea was in the opinion of the superior court justice of such doubt and importance as to require determination by us before further proceedings in that court.
