In an action for the partition of real property, the purchaser at a Referee’s auction of the premises which is the subject of the action appeals, as limited by its brief, from so much of an order of the Supreme Court, Nassau County (Becker, J.), dated July 16, 1985, as denied its cross motion for the release to it of moneys held by the Referee.

*697Ordered that the order is affirmed, insofar as appealed from, with costs.

By an amended judgment dated September 6, 1983, a Referee was appointed in this partition action. The Referee published the terms of the sale and entered into a memorandum of sale…
