EISELE, Chief Judge.

Pending before the Court is the motion for summary judgment filed by defendant Transport Insurance Company. Because the Court finds genuine issues of material fact remain, it denies the motion.

This is an action for compensatory and punitive damages- stemming from the nonpayment on a collision insurance policy that the defendant issued to the plaintiff. The plaintiff is a motor freight transportation company that operates a fleet of tractor-trailer rigs.
