Petitioner Derrick Sonnier, a Texas death row inmate, filed a petition for a writ of habeas corpus under 28 U.S.C. § 225í with the United States District Court for the Southern District of Texas on June 4, 2004 and amended it on August 5, 2004. Respondent Doug Dretke1 filed a motion *355for summary judgment on July 14, 2005. The district court granted respondent’s motion for summary judgment and denied Sonnier’s petition for a writ of habeas corpus in a memorandum and order dated January 23, 2006.
