*1274Appeal from a judgment of the Erie County Court (Michael L. D’Amico, J.), rendered January 31, 2012. The judgment convicted defendant, upon a nonjury verdict, of assault in the second degree and harassment in the second degree.

It is hereby ordered that the judgment so appealed from is unanimously affirmed.
