This is an appeal from an order of the district court granting summary judgment in favor of the respondents and against *124the appellant, Charlotte Arley. For the reasons hereinafter set forth, we reverse, and we remand the case to the court below for a trial on its merits.

Charlotte Arley sought a declaratory judgment declaring her rights to bid on a parcel of State real property which the State intended to sell to Respondents Berzinskis and Agertons ataprivate sale under the provisions of NRS 408.999(1)(c).1
