The question presented on this appeal is whether the Commissioner of Public Safety revoked appellee’s driver’s license in accordance with the provisions of KRS 186.-565. The revocation of the license was based on the Commissioner’s finding that appellee had refused to submit to a blood test when he was requested to take such a test following his arrest for driving while intoxicated. On appeal, the Spencer Circuit Court found that there was not sufficient substantial evidence to support the Commissioner’s finding and the order revoking appellee’s driver’s license was set…
