The only question presented to us for our consideration in this case is do the mortgages read in evidence give to the interpleader a better title to the mortgaged property at law or equity than that acquired by virtue of the attachment proceedings? At the time the attachment was levied upon the property in controversy, as well as at the time the judgments were rendered in the original suit between the plaintiff and the defendant in 'the attachment suit, the law governing the recording of mortgages in the Indian Territory was as follows: “All mortgages, whether for real or personal estate,…
