The complaint in this case unites two causes of action; first, that Zephaniah Young should be declared a *95trustee of the land described in the complaint, for the benefit of the plaintiff, and that he be compelled to convey the same to him, and for damages; second, that Zephaniah Young, Seth Young, B. S. Young, and William Hutchins, are indebted to him for the purchase money of the land in controversy, with interest, for which they are liable by reason of a conspiracy between them to cheat and defraud the plaintiff out of the land.
