FANNING, Justice.

This is a child custody case. The judgment was signed and entered by the trial judge on September 15, 1959. The transcript was timely filed on November 2, 1959, in the Court of Civil Appeals for the 5th Supreme Judicial District of Texas, at Dallas, Texas. On November 13, 1959 the Dallas Court of Civil Appeals granted a thirty day extension for appellant to file a statement of facts in the case.
