This is an action by .the plaintiff to recover the sum of $3,750 which he claims he lost to the defendant playing dice. The facts are as follows: In September, 1971, plaintiff and defendant Katz met on a plane on a flight from New York to the island of St. Maarten in the Carribbean. According to the plaintiff, they were going to the island for a period of five days ‘ ‘ for the purpose of gambling ’ ’.
