Kenneth Carol Spell appeals from his conviction of murder and sentence of life imprisonment, and from the denial of his motion for new trial, as amended.
The appellant enumerates as error the denial of his special *706plea to the arraignment. This plea asserted that: He filed a special plea of insanity, and a jury trying the issue found against the plea. His motion for new trial is pending, and should be disposed of prior to his arraignment on the indictment.
