This is an appeal from a judgment of the district court of Payne county. • The plaintiff in error was defendant and the defendant in error was plaintiff hi the trial court and will be referred to in this opinion as they were there. It appears from the record that the plaintiff in 1935 was a railroad grade and! oil field team contractor, and had been for many years; and prior to October 7. 1915, w-as a resid'ent of Drumright, in Creek county; and was the owner of certain personal property. consisting of teams, wagons, harness, etc., which he used in his contract work.…
