The indictment contained two counts: the first, larceny from a railway car'; and the second, simple larceny. On the trial, the State abandoned the second count and insisted upon the first alone. The goods stolen were taken from a railway car that left Chattanooga, Tennessee, one night and arrived at Cartersville in Bartow county the next morning. On the next day the defendant was found in possession of a portion of the stolen goods, at Dalton, in Whitfield county, between Chattanooga and Cartersville.
