I respectfully dissent. I would affirm the judgment of the district court.
Plaintiff Karyn Risch complains that the Royal Oak Police Department’s denial of her promotion to detective in 2005 was based upon an unlawful reason — sex discrimination. However, “[t]he ultimate burden of persuading the trier of fact that the defendant intentionally discriminated against the plaintiff remains at all times with the plaintiff.” Tex. Dep’t of Cmty.
