JOHN W. OLIVER, District Judge.. This Memorandum and Order determines another preliminary matter in the same income tax case reported as United States v. Sermon, W.D.Mo.1963, 218 F.Supp. 871. In the earlier matter we ruled defendant’s motion for bill of particulars and his motion for discovery and inspection and made further orders directing further proceedings in this case.
