Assumpsit for $1000,00 damages in the district court of Dubuque county. The plaintiff filed bis declaration setting forth as the gravamen of bis action, a special contract made by himself and the defendant Bush, on the 24th day of July, 1849. By which it was agreed, that “the said Chapman was to do the millwright work of a flouring mill for the said John D. Bush, in the stone building erected for this business in the city and county of Dubuque, state of Iowa. Bush was to furnish all the materials for the same.
