ORDER
ATLAS, District Judge.
The parties have filed a Joint Motion requesting that this Court vacate its Memorandum Opinion and Order [Doe. #75], dated August 7, 1997, published at 981 F.Supp. 1013 (S.D.Tex.1997), which granted in part and denied in part Defendants’ Motion to Dismiss [Doc. # 59]. For the reasons stated below, the parties’ Motion to Vacate is GRANTED, and this Court’s previous Memorandum Opinion and Order are withdrawn as lacking factual foundation.
