Appeals from a judgment of the Supreme Court, Monroe County (Kenneth R. Fisher, J.), entered August 25, 2010 in a breach of contract action. The judgment, upon a nonjury trial, awarded plaintiff the principal sum of $347,682.14 plus interest and costs against defendants.

It is hereby ordered that the judgment so appealed from is unanimously modified on the law by reducing the award of damages for those items identified as construction change directive (CCD) No. 1 to $4,800, CCD No. 2 to $86,000, CCD No. 3 to $43,305 and CCD No. 4 to $55,758, providing that statutory interest on the reduced…
