1Opinion of the Court

YOUNG, Justice.

This appeal is from an order overruling the venue plea of Louise Nemec (formerly Degelia) and husband to be sued in the county of their residence- — -Kaufman. The parties disagree concerning nature of the action — appellants asserting that it is one seeking to alter or amend custodial rights in and to the minor son, John Degelia, Jr., born of the former marriage of the Degel-ias; the position of appellee petitioner being that the proceeding is simply to enforce visitation rights accorded to him in a 1947 judgment of divorce.
