Affirming. .
'In a suit to settle the estate of Maria L. Bethel and to foreclose certain real estate, mortgage liens executed by her, the appellant, one of the children of Maria Bethel, filed an answer and counterclaim, ■ asserting that one of the tracts of land mentioned was owned by the heirs at Jaw of the testatrix, and that the mortgage executed thereon by testatrix and sought to be enforced in the action was void. A demurrer was sustained to this pleading and she has appealed.
