At the time of the filing of this action, the appellant, The Waverly Company, was a corporation owning certain real estate located in the City of Indianapolis, Indiana, and known generally as 135 South East Street. The appellant Inter-State Motor Freight System had leased the premises from the owner, The Waverly Company, and it was provided in the lease that certain changes should be made in the building.
