The defendant was convicted of the murder of Will Burr, and brings before this court for review the judgment overruling his motion for new trial. The special assignments of error are as follows: (4) “Because upon the trial of said case the court charged the jury as follows: ‘A person shall not be found guilty of any crime or misdemeanor committed by misfortune or accident, and where it satisfactorily appears that there was no evil design, or intention, or culpable neglect.
