Appellant was indicted, tried, and convicted pursuant to the statute that provides for a sentence of death or life imprisonment without parole in certain aggravated offenses. Acts 1975, No. 213. The jury found him guilty and fixed his punishment at death. The court thereafter conducted a hearing pursuant to § 3 of the Act and in accordance with § 4 sentenced defendant to life imprisonment without parole.
