The plaintiff in error was found guilty of murder in the first degree, and has been sentenced to be hung. There are but two questions presented to us on the writ of error:
1. The defendant before making a statement of his defense to the jury offered to prove by one Lee Wood, *242a witness who had been sworn, that the deceased, Hollis Wilson, had on the day before the homicide made threats of violence against the defendant, and the State objected on the ground that no foundation had been laid, and the court sustained the objection, and the prisoner excepted.
