OPINION

ORME, Judge:

[ 1 Defendant Shayne Todd was convicted of murder, a first degree felony under Utah Code Ann. § 76-5-208 (20083), and possession of a dangerous weapon by a restricted person, a second degree felony under Utah Code Ann. § 76-10-5088) (20083). Defendant claims the trial court erred in failing to grant his motion for a new trial, which was based on allegedly improper statements made by the prosecutor during closing argument. Because Defendant's motion for new trial was not timely filed, we dismiss the appeal for lack of jurisdiction.
