Appeal from a judgment of the County Court of Rensselaer County (McGrath, J.), rendered April 17, 1996, upon a verdict convicting defendant of the crime of murder in the second degree.

Defendant was indicted by a Rensselaer County Grand Jury for murder in the second degree (two counts) arising from the strangulation death of Louise Jenowski (hereinafter the victim) on April 27, 1991 in the City of Troy, Rensselaer County.
