Appeal from an order and judgment of the Supreme Court (Dier, J.), entered September 11, 1993 in Warren County, which, inter alia, granted plaintiffs motion for summary judgment.

In 1973 defendants William J. Lennon and Katherine E. Lennon received approval from plaintiff for development of a 25-lot subdivision, to be known as Colonial Ridge Estates, situated on County Road No. 35 in the Town of Lake George, Warren County.
