This action was filed April 3, 1954 to recover damages allegedly occasioned by the negligence of the defendant in operating his truck.

The complaint alleges in substance that Robert G. Baker, an employee of plaintiff, was killed on July 23, 1952 in a collision between a truck which he was operating and another truck owned and operated by defendant; that at the time of the occurrence the deceased was engaged within the scope of his employment : that the accident was caused by the negligence of the defendant; that as the result of the defendant’s…
